Welcome to Vision Celestia. By accessing or using our intelligent security and property management platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Vision Celestia services, you agree to these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you may not use our services.

2. Service Description

Vision Celestia provides: • Intelligent video surveillance and monitoring • Facial recognition and access control (optional) • Visitor and guest management • License plate recognition (LPR) • Property and maintenance management • Assembly and meeting management • Communication tools for residents and staff • IoT device integration and control • Guard patrol and checkpoint management

3. User Accounts and Responsibilities

You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Ensuring your information is accurate and up-to-date • Notifying us immediately of any unauthorized access • Complying with all applicable laws and regulations • Using the service only for lawful purposes

4. Acceptable Use Policy

You agree NOT to: • Use the service for illegal activities • Violate others' privacy or rights • Attempt to gain unauthorized access to our systems • Interfere with or disrupt the service • Upload malicious code or viruses • Harass, abuse, or harm others • Misuse facial recognition or surveillance features • Share your account with unauthorized users

5. Subscription and Billing

• Subscriptions are billed monthly or annually in advance • Prices are subject to change with 30 days notice • Refunds are provided only as required by law • You may cancel your subscription at any time • Cancellation takes effect at the end of the billing period • Overdue payments may result in service suspension

6. Data Ownership and License

• You retain ownership of your data and content • You grant us a license to use your data to provide services • Camera footage and recordings belong to the property owner • We may use anonymized data for analytics and improvements • You can export or delete your data at any time

7. Facial Recognition Consent

• Facial recognition is an optional feature • Explicit consent is required before enrollment • You can opt-out or delete your facial data at any time • Facial data is used only for authorized access control • We comply with all biometric privacy laws (BIPA, GDPR, etc.)

8. Service Availability and Support

• We strive for 99.9% uptime but do not guarantee uninterrupted service • Scheduled maintenance will be announced in advance • Support is available via email and in-app chat • Response times vary by subscription tier • Emergency support is available for critical security issues

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • We are not liable for indirect, incidental, or consequential damages • Our total liability is limited to the amount you paid in the last 12 months • We are not responsible for third-party services or integrations • You use the service at your own risk • We do not guarantee prevention of all security incidents

10. Indemnification

You agree to indemnify and hold Vision Celestia harmless from any claims, damages, or expenses arising from: • Your use of the service • Your violation of these Terms • Your violation of any laws or third-party rights • Misuse of surveillance or facial recognition features

11. Termination

We may suspend or terminate your account if: • You violate these Terms of Service • You engage in fraudulent activity • Your account is inactive for over 12 months • Required by law or legal process Upon termination, you may export your data within 30 days.

12. Governing Law and Disputes

• These Terms are governed by the laws of California, USA • Disputes will be resolved through binding arbitration • You waive the right to participate in class actions • Arbitration will be conducted by JAMS under their rules • You may opt-out of arbitration within 30 days of account creation

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
